Termos de Serviço

Assess4Me bv · Versão v5 · 13 de outubro de 2026

Este documento só está disponível em inglês. A versão em inglês é juridicamente vinculativa.

Introduction

These Terms of Service ("Terms") constitute the agreement between you ("User", "you", "your") and Assess4Me bv ("Assess4Me", "we", "us", "our"), a company established in Belgium. By using our platform or services you agree to these Terms. If you act on behalf of an organisation, you represent that you are authorised to accept these Terms on that organisation's behalf.

What has changed in this version

  • We keep an anonymised copy of each completed game play to calibrate and validate our games. The copy contains no name, e-mail address or other identifier, and is never used to evaluate an individual candidate (section 8).

1. Definitions

  • Services: all products and features offered by Assess4Me, including game-based assessments, quizzes, organisation dashboards, candidate management, AI features, reports, integrations and related infrastructure.
  • Organisation: a company, institution or entity that registers on the platform to create vacancies, invite candidates and review results.
  • Organisation member: a User who belongs to an Organisation's team. The User who creates the Organisation is its creator; other Users join as members by invitation.
  • Candidate: a person who completes assessments at the invitation of an Organisation, directly or through a Partner.
  • Partner: a recruitment software provider (for example an applicant tracking system) that an Organisation connects to Assess4Me.
  • User: any person accessing the platform, whether as a Candidate, an Organisation member or an administrator.
  • Account: a personal account through which access to the platform is obtained.
  • Customer Content: content an Organisation creates or uploads on the platform, such as vacancies, assessment configurations, quizzes, company information and logos, including content generated with our AI features at the Organisation's request.

2. Access and use of the service

You must create an account to use our services. When creating an account you must provide accurate, complete and up-to-date information. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.

Organisation accounts are intended for business use. Candidates use the platform free of charge.

Our services are intended for recruitment and assessment purposes by Organisations and for Candidates completing assessments. Misuse or deceptive use is prohibited.

Teams. An Organisation can invite members to its team, within the number of seats included in its plan. The Organisation is responsible for who it invites and for removing access when a member leaves.

Candidate accounts created for you. When an Organisation invites you through a Partner, an account may be created for you so that you can complete the assessment. These Terms apply when you use that account.

Separate agreements. Where Assess4Me and an Organisation agree separate terms in writing (for example for a pilot, an enterprise plan or invoicing outside our online checkout), those terms prevail over these Terms to the extent they differ.

3. Free trial

New Organisations can start a 14-day free trial when signing up for a plan that includes one. Whether a plan includes a free trial is shown on our website and when you sign up; a plan without a free trial starts as a paid subscription right away. No payment is required to start a trial. During the trial:

  • you can create one vacancy and invite up to five candidates;
  • no per-candidate fee is charged for candidates who complete their assessment;
  • the features and limits of your selected plan apply;
  • you can change once to another plan that includes a free trial. The trial keeps its original end date. Choosing a plan without a free trial ends the trial and starts that plan as a paid subscription.

At the end of the trial, continued access requires an active paid subscription. If no payment method has been added by then, your subscription is paused and access to the platform is restricted until you subscribe. Your data is kept in accordance with the Privacy Policy. Promotion codes cannot be applied during a trial. We reserve the right to modify or discontinue trial terms at any time with reasonable notice.

4. Subscriptions and payment

4.1 Subscription plans

Assess4Me offers monthly and annual subscription plans. Current prices and what each plan includes (such as the number of seats, the number of candidate invitations per month, the per-candidate fee, access to features such as custom content, AI features, PDF reports and the API, and priority support) are listed on our website and in your account. All amounts are exclusive of VAT unless stated otherwise. Annual plans are charged in full at the start of the billing period.

4.2 Changing plans

You can upgrade or downgrade your plan from your account. Changes take effect immediately and are prorated: you receive a credit for the unused part of your current plan and are charged for the remainder of the new plan. If your team or usage exceeds the limits of a lower plan, you must first reduce it (for example by pausing members or cancelling open invitations) before downgrading.

4.3 Per-candidate fee

In addition to the subscription fee, a per-candidate charge applies for each candidate who completes an assessment. This fee covers platform use, scoring infrastructure and AI evaluation for that candidate. The amount depends on your plan and is shown on our website and in your account: €149 (excl. VAT) unless your plan includes a lower fee.

  • The fee of the plan you are on when the candidate completes the assessment applies.

  • A candidate has completed an assessment when they have finished every part of it (all games and quizzes) for a vacancy.

  • The fee is charged once per candidate per vacancy. Retakes for the same vacancy are not charged again.

  • Invitations to candidates who do not complete their assessment are not charged.

  • Completions during the free trial and completions of an Organisation's profile assessment are not charged.

Per-candidate fees are added to your next subscription invoice. We may also invoice them separately.

4.4 Payment processing

Payments are processed by Stripe. By subscribing you authorise Assess4Me to charge the payment method on file at the applicable billing frequency, as well as per-candidate fees. In case of failed payment, we will notify you and may suspend access until payment is resolved.

4.5 Refunds

Subscription fees are non-refundable except where required by applicable law, and except for prorated credits when you change plans (section 4.2). Per-candidate charges are non-refundable once the candidate has completed their assessment and the evaluation has been generated.

4.6 VAT

All prices on our website and in your subscription are expressed excluding VAT. VAT is calculated and added at checkout based on your billing country and VAT number:

  • Belgian customers are charged 21% Belgian VAT.
  • Customers in other EU countries with a valid VAT number pay 0% VAT under the reverse-charge mechanism (Article 196 of the EU VAT Directive). You remain responsible for self-accounting VAT in your own country.
  • Customers outside the EU are not charged Belgian VAT.

The applicable VAT treatment is shown at checkout and on every invoice issued by Assess4Me.

5. AI features

As part of the Services, Assess4Me uses AI models (currently from OpenAI) to evaluate assessment results, produce interview guides, answer recruiters' questions about candidates, and help Organisations draft vacancies, assessments and quizzes. Our scoring framework is called the Assess4Me Integrated Model (AIM). The following applies:

  • AI output is a decision support tool for recruiters. It is never the sole basis for a hiring decision. The final decision always rests with the recruiter or hiring manager.
  • For evaluations, the AI receives game and quiz results and related assessment data, identified by an internal identifier only. The AI does not receive candidates' e-mail addresses. When a recruiter asks the AI assistant about all candidates of a vacancy, candidates' display names are included. Details are in our Privacy Policy.
  • Evaluations are configured to give consistent results, and identical input is answered from a cache. AI output can nevertheless vary and may contain errors. Recruiters should review results critically.
  • AI-generated content (for example a quiz or vacancy text) is a draft. The Organisation is responsible for reviewing it before use.
  • Organisations that use AI features to assess candidates are responsible for using them lawfully, including providing human oversight and informing candidates where applicable law requires it (for example under the GDPR and the EU AI Act).

6. Customer Content

Organisations retain ownership of their Customer Content. The Organisation grants Assess4Me a non-exclusive licence to host, copy, process, translate and display Customer Content to the extent necessary to provide and improve the Services. Where the platform lets an Organisation share content with other users, the Organisation grants those users the right to use that content within the platform.

The Organisation is responsible for its Customer Content, including content generated with our AI features at its request, and guarantees that it has the necessary rights and that the content does not infringe the rights of others or applicable law. We may remove content that violates these Terms.

7. Developer access and integrations

Depending on its plan, an Organisation can connect its own systems to Assess4Me through our API, webhooks and integration for AI tools (MCP), and can work with Partners.

  • API keys are confidential. You are responsible for all use of your keys and must revoke a key if it may have been exposed.
  • When you send data out of Assess4Me (for example results via a webhook, the API or your own AI assistant), you are responsible for that data and for the systems that receive it.
  • We may apply rate limits and suspend keys or integrations that are misused or that endanger the platform.
  • Partners may be subject to an additional partner agreement.

8. Data protection

When an Organisation uses the Services to assess candidates, the Organisation is the controller of the candidate data and Assess4Me processes it on the Organisation's behalf. Our Data Processing Agreement, available on request, forms part of these Terms for Organisations. The Organisation is responsible for having a legal basis to invite candidates and for informing them about the processing, including monitoring of browser-tab activity during assessments and the use of AI. How we process personal data is described in our Privacy Policy.

Anonymised research data. To check and improve how well our games measure what they are designed to measure, we keep an anonymised copy of each completed game play. The copy holds:

  • the game and its version;
  • the date, not the time;
  • the score and the in-game responses and timings;
  • coarse technical context: input type, screen size rounded to 50 pixels, and language.

It contains no name, e-mail address, account, Organisation, vacancy or other identifier, and it is not linked to the candidate's result. We only make it for candidates who have accepted this version of the Terms, and never for test candidates.

We use these copies only in aggregate: to set the difficulty of our games, to measure their reliability, to build comparison groups and to check that results do not differ by device or language. They are never used to evaluate or rank an individual candidate. Because they are anonymous, they are kept when a candidate's account or an Organisation's data is deleted. Under the Data Processing Agreement, the Organisation instructs us to make these anonymised copies as part of the processing.

9. Prohibited use

You may not use our services for:

  • unlawful, fraudulent or harmful purposes;
  • uploading or distributing material that infringes on the rights of third parties, including intellectual property or privacy rights;
  • attempting to reverse-engineer, circumvent or gain unauthorised access to any part of the platform, or completing an assessment on behalf of someone else;
  • discriminatory practices that violate applicable law, including anti-discrimination legislation;
  • sharing, reselling or exposing API keys or account access to third parties without our consent;
  • use by persons under the age of 16, unless valid legal consent has been obtained.

10. Ownership and intellectual property

Assess4Me retains all rights, title and interest in its platform, software, games, AI models and prompts, content, documentation, trademarks and copyrights. Organisations retain ownership of their Customer Content (section 6). Candidates retain rights to their personal data as described in the Privacy Policy.

11. Duration and termination

The agreement runs from the moment you accept these Terms and activate your account. You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate access if you violate these Terms or fail to make payment.

You can delete your account at any time from your account settings. Upon termination or deletion, access to your account and stored data ends in accordance with the retention periods set out in the Privacy Policy.

12. Liability

Assess4Me strives for reliable and accurate operation but does not guarantee that the platform will be error-free or uninterrupted. To the maximum extent permitted by law, Assess4Me is not liable for indirect damage, consequential damage, loss of data or loss of profit, nor for hiring decisions made by Organisations. You indemnify Assess4Me against claims from third parties arising from your use of the platform in violation of these Terms or applicable law.

13. Changes to the service and these Terms

We may update the platform or these Terms at any time. For material changes we will notify you by e-mail or via the platform at least 14 days in advance, and may ask you to accept the updated Terms before you continue using the platform. Continued use of the platform after the effective date of a change constitutes acceptance of the updated Terms. Previous versions remain available on this page.

14. Governing law and disputes

These Terms are governed by Belgian law and applicable EU legislation including the GDPR. Disputes will be submitted to the competent courts in Belgium.

15. Miscellaneous

  • Entire agreement: these Terms together with the Privacy Policy, the Cookie Policy and, for Organisations, the Data Processing Agreement constitute the entire agreement between you and Assess4Me and supersede any prior agreements, subject to section 2 (separate agreements).
  • Severability: if any provision is found to be invalid or unenforceable, the remaining provisions remain in full effect.
  • Notices: important communications will be sent by e-mail to the address registered on your account.
