Terms of Service — Assess4Me bv

Introduction

These Terms of Service ("Terms") constitute the agreement between you ("User", "you", "your") and Assess4Me bv ("Assess4Me", "we", "us", "our"), a company established in Belgium. By using our platform or services you agree to these Terms. If you act on behalf of an organisation, you represent that you are authorised to accept these Terms on that organisation's behalf.

1. Definitions

  • Services: all products and features offered by Assess4Me, including game-based assessments, organisation dashboards, candidate management, AI-generated evaluations, and related infrastructure.
  • Organisation: a company, institution or entity that registers on the platform to create vacancies, invite candidates, and review results.
  • Candidate: a person who completes assessments via an invitation link issued by an Organisation.
  • User: any person accessing the platform, whether as a Candidate, an Organisation member, or an administrator.
  • Account: a personal or organisation account through which access to the platform is obtained.

2. Access and use of the service

You must create an account to use our services. When creating an account you must provide accurate, complete and up-to-date information. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.

Our services are intended for recruitment and assessment purposes by Organisations and for Candidates completing assessments. Misuse or deceptive use is prohibited.

3. Free trial

New Organisation accounts receive a 14-day free trial with access to the features of their selected plan. No payment is required to start a trial. At the end of the trial period, continued access requires an active paid subscription. We reserve the right to modify or discontinue trial terms at any time with reasonable notice.

4. Subscriptions and payment

4.1 Subscription plans

Assess4Me offers monthly and annual subscription plans. Current prices are listed on our website. All amounts are exclusive of VAT unless stated otherwise. Annual plans are charged in full at the start of the billing period.

4.2 Per-candidate fee

In addition to the subscription fee, a per-candidate charge of €149 (excl. VAT) applies for each candidate who completes an assessment. This fee covers platform use, scoring infrastructure, and AI evaluation for that candidate run. You are only charged when a candidate fully completes their assigned assessment. Invitations sent to candidates who do not complete their assessment are not charged.

4.3 Payment processing

Payments are processed by Stripe. By subscribing you authorise Assess4Me to charge the payment method on file at the applicable billing frequency. In case of failed payment, we will notify you and may suspend access until payment is resolved.

4.4 Refunds

Subscription fees are non-refundable except where required by applicable law. Per-candidate charges are non-refundable once the candidate has completed their assessment and the evaluation has been generated.

4.5 VAT

If you provide a valid VAT number for your Organisation, reverse charge rules apply where applicable under Belgian and EU tax law.

5. AI evaluation

As part of the Services, Assess4Me generates AI-powered evaluations of candidate assessment results using the Assess4Me Integrated Model (AIM). The following applies:

  • AI evaluations are decision support tools for recruiters. They are never the sole basis for a hiring decision. The final decision always rests with the recruiter or hiring manager.
  • Only anonymised game metrics (scores, reaction times, attempt counts) are submitted to the AI. No direct personal identifiers such as name or email address are included.
  • AI evaluations are deterministic by design. The same input data will produce the same output.
  • Assess4Me does not guarantee that AI-generated content is free from errors. Recruiters should review results critically.

6. Prohibited use

You may not use our services for:

  • unlawful, fraudulent or harmful purposes;
  • uploading or distributing material that infringes on the rights of third parties, including intellectual property or privacy rights;
  • attempting to reverse-engineer, circumvent or gain unauthorised access to any part of the platform;
  • discriminatory practices that violate applicable law, including anti-discrimination legislation;
  • use by persons under the age of 16, unless valid legal consent has been obtained.

7. Ownership and intellectual property

Assess4Me retains all rights, title and interest in its platform, software, content, documentation, trademarks and copyrights. Organisations retain ownership of content they create on the platform, including vacancies and custom assessment configurations. Candidates retain rights to their personal data as described in the Privacy Policy.

8. Duration and termination

The agreement runs from the moment you accept these Terms and activate your account. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate access if you violate these Terms or fail to make payment.

Upon termination, access to your account and stored data will expire in accordance with the retention periods set out in the Privacy Policy.

9. Liability

Assess4Me strives for reliable and accurate operation but does not guarantee that the platform will be error-free or uninterrupted. To the maximum extent permitted by law, Assess4Me is not liable for indirect damage, consequential damage, loss of data or loss of profit. You indemnify Assess4Me against claims from third parties arising from your use of the platform in violation of these Terms or applicable law.

10. Changes to the service and these Terms

We may update the platform or these Terms at any time. For material changes we will notify you by email or via the platform at least 14 days in advance. Continued use of the platform after the effective date of a change constitutes acceptance of the updated Terms.

11. Governing law and disputes

These Terms are governed by Belgian law and applicable EU legislation including the GDPR. Disputes will be submitted to the competent courts in Belgium.

12. Miscellaneous

  • Entire agreement: these Terms together with the Privacy Policy and Cookie Policy constitute the entire agreement between you and Assess4Me and supersede any prior agreements.
  • Severability: if any provision is found to be invalid or unenforceable, the remaining provisions remain in full effect.
  • Notices: important communications will be sent by email to the address registered on your account.
